Affirmative Action
Companies that have Federal contracts or subcontracts of at least $50,000 and employ at least 50 employees; or companies that have been mandated by issuance of a court order because of previous engagement in "unlawful discrimination;" or companies that have a "conciliation agreement" with the Equal Employment Opportunity Commission have a responsibility to monitor and enforce an Affirmative Action Plan.

Our professionals can help you develop and implement an appropriate plan.

Alternative Dispute Resolution
Most employers recognize that if they are in business long enough, the day will come when an employee decides to sue them.  Regardless of the merit of the case, we feel binding arbitration is the most effective method of resolving such controversies.  If properly constructed, ADR has proven to significantly dissipate frivolous lawsuits and reduce both the length of the proceedings as well as the expense of meritorious suits.

Benefits Presentations
Over the last 30 years, we have found that employers generally do a poor job of educating employees on their benefits package.  For example, most employees do not realize that, on average, their employer contributes an additional 35% of their salary to benefits.

Our professionals sit down with employees in small groups to educate them on their current list of benefits, how to exercise these benefits and illustrate the “hidden” benefits employees are generally not aware of.

Employee Handbooks
The Employee Handbook is one of the most important documents an organization produces.  It is a document that can form a solid foundation for employee relations or give rise to employee angst and/or litigation. Therefore, it is recommended that your Employee Handbook be reviewed legally updated every 12-18 months.

LRSI professionals will review your handbook to ensure that it conforms to current Federal and State regulations.  In addition, we recommend that your handbook incorporate your organization’s “non-union philosophy” along with appropriate “non-distribution” and “non-solicitation” verbiage.

Employee Reference Checking
Effective reference-checking programs help ensure that your organization hires qualified personnel that are well suited for your organization and help minimize employee turnover.  Successful, comprehensive reference checking practices on the front end of the hiring process have a huge impact on a organization’s bottom line profitability and it is an element that you can easily control.

Research indicates that the cost of replacing an employee can be up to 150% of the employee’s annual wages (due to costs of recruiting, training, lost productivity, etc…), making it imperative that businesses hire the right people the first time around.

Immigration
The recent government raids in businesses across the country have thrust the issue of immigration and undocumented workers into the national spotlight once again.  The Department of Homeland Security is cracking down on the organizations that are utilizing undocumented workers and the penalties can reach up to $11,000.00 per undocumented worker.

Our unique relationship with Form I-9 Compliance, LLC allows us to verify employment eligibility of all newly hired employees.  This program serves to effectively protect organizations from unknowingly hiring employees that are ineligible to work in the U.S.

Wage and Hour Audits
Farmers Insurance was hit with a $90 million verdict for failure to pay overtime and Wal-Mart is currently defending similar lawsuits in 25 states.  LRSI professionals can help protect your organization from such Wage and Hour liabilities.

Wage and Hour issues represent one of the most rapidly increasing sources of litigation for U.S. employers.  Even the most well intended organizations can find themselves subject to penalties of two year’s back pay for overtime miscalculations in addition to “liquidated damages,” which effectively double the amount of an employer’s liability.

By helping to ensure that you are in compliance with federal and state regulations and that employees are classified correctly, LRSI can minimize your organization’s potential for Wage and Hour liabilities.  We will provide you with peace of mind so that you can focus on other important things - like growing your business.
